Botton + Gardiner Limited and Exclusive Warranty

BARESQUE USA LLC (“BARESQUE”) WARRANTS TO THE PURCHASER THAT FOR A PERIOD OF FIVE YEARS AFTER DELIVERY (THE “WARRANTY PERIOD”), BARESQUE’S BOTTON + GARDINER MATERIAL (THE “PRODUCT”) WILL BE FREE OF MANUFACTURING DEFECTS (THE “WARRANTY”).

BARESQUE’S RESPONSIBILITY FOR A DEFECTIVE PRODUCT IS LIMITED TO REPLACEMENT OR REFUNDS AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

EXCEPT AS PROVIDED IN THE WARRANTY, BARESQUE MAKES NO WARRANTY WHATSEOVER WITH RESPECT TO THE PRODUCT, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG A WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO THE PURCHASER.

The Warranty is the sole and exclusive warranty given by Baresque with respect to the Product. The Warranty covers the Purchaser of this product only and is not transferable without Baresque’s written consent. The Warranty does not cover and expressly excludes any claim, damage, loss, or expense arising out of or relating to: a) accident or vandalism; b) abuse, misuse, unapproved use of the Product, or other external causes beyond Baresque’s reasonable control; c) installation contrary to the instructions and reasonable installation practices; d) mold or mildew; e) abnormal conditions of use; f) improper maintenance;  g) unauthorized repair; (h) normal wear and tear; (i) transportation; or (j) design, installation, or construction deficiencies of any kind or nature. The terms of the Warranty comprise the entire agreement between Baresque and the Purchaser, and supersede all prior or contemporaneous understandings, agreements, negotiations, representations and warranties, and communications, both written and oral. The terms of the Warranty prevail over any of Baresque’s general terms and conditions of purchase. The Warranty is not assignable or transferable.

With respect to any defective product during the Warranty Period, Baresque, in its sole discretion, will replace the Product or refund the purchase price of the Product paid by the Purchaser.

The Warranty is not extended if Baresque replaces the Product. Baresque may change the availability of this limited warranty at its discretion, but any changes will not be retroactive.

THE REMEDIES DESCRIBED ABOVE ARE THE PURCHASER’S SOLE AND EXCLUSIVE REMEDIES AND BARESQUE’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. BARESQUE’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCCEED THE ACTUAL AMOUNT PAID BY THE PURCHASER FOR THE DEFECTIVE PRODUCT, NOR SHALL BARESQUE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

To make a warranty claim, the Purchaser must contact Baresque at (855) 922-7377 or via email at info@baresque.com during the Warranty Period. Baresque will require the following information to process a claim:

  • Proof of purchase (copy of invoice, pint of sale receipt or sales order);

  • Image and description of fault;

  • Address where the Product is currently located; and

  • Contact details (most correspond to the Purchaser’s details).

Baresque will try to respond to each warranty claim within fifteen days. Note that the Purchaser is responsible for the cost of delivering the Product to Baresque and the Purchaser should insure any delivery of the Product. If the warranty claim is approved by Baresque, the Purchaser’s documented delivery costs will be reimbursed by Baresque.
